These Terms of Service ("Terms") govern your access to and use of the CourtConnect platform and website operated by HBZ Holdings, LLC ("Company," "we," "us," or "our"). By accessing or using our platform, you agree to be bound by these Terms.
1. Definitions
- "Platform" refers to the CourtConnect website, application, and related services.
- "Client" refers to any law firm, AI legal company, solo practitioner, or organization that posts appearance requests on the Platform.
- "Attorney" refers to any licensed attorney who registers on the Platform to accept and fulfill court appearance requests.
- "Appearance" refers to an in-person court appearance posted on the Platform by a Client and fulfilled by an Attorney.
- "User" refers to any individual or entity that accesses or uses the Platform, whether as a Client, Attorney, or visitor.
2. Eligibility
To use the Platform as an Attorney, you must:
- Hold an active license to practice law in at least one U.S. jurisdiction
- Maintain active professional malpractice insurance
- Be in good standing with all bar associations in which you are admitted
- Be at least 18 years of age
To use the Platform as a Client, you must be a law firm, AI legal services company, or other organization legally authorized to engage appearance counsel.
3. Platform Services
CourtConnect operates as a marketplace that connects Clients who need in-person court representation with Attorneys who can provide it. We facilitate the matching, communication, and payment between parties.
CourtConnect is not a law firm. We do not provide legal advice, representation, or counsel. The attorneys on our Platform are independent professionals, not employees or agents of CourtConnect.
4. Attorney Obligations
By registering as an Attorney on the Platform, you agree to:
- Maintain an active bar license and malpractice insurance at all times
- Provide accurate and current information about your credentials and availability
- Appear at all accepted court dates on time and prepared
- Act in accordance with all applicable rules of professional conduct
- Submit timely and accurate outcome reports following each appearance
- Notify the Platform immediately if your bar status or insurance coverage changes
5. Client Obligations
By using the Platform as a Client, you agree to:
- Provide accurate and complete information for each appearance request
- Supply all relevant case materials to the assigned Attorney in a timely manner
- Pay for completed appearances according to the agreed-upon rate
- Not engage in conduct that would compromise the Attorney's professional obligations
6. Fees and Payment
Clients are charged per appearance at rates that vary based on case type, complexity, jurisdiction, and other factors. Specific pricing is displayed when posting an appearance request.
Attorneys are paid for completed appearances after submitting an outcome report. Payment is processed via our payment provider (Stripe) and deposited within 5 business days of approval.
CourtConnect retains a service fee from each transaction. The fee structure is disclosed to both parties before any engagement.
7. Cancellation Policy
- Client Cancellations: Appearances may be cancelled up to 24 hours before the scheduled court date at no charge. Cancellations within 24 hours may be subject to a cancellation fee.
- Attorney Cancellations: Accepted appearances may be cancelled up to 48 hours before the scheduled court date. Late cancellations or no-shows may result in reduced matching priority, financial penalties, or removal from the Platform.
8. Verification and Quality
We verify Attorney bar status and malpractice insurance as part of our onboarding process and on an ongoing basis. However, we do not guarantee the outcome of any court appearance. Clients are responsible for evaluating the suitability of any Attorney for their specific needs.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURTCONNECT AND HBZ HOLDINGS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use of or inability to use the Platform
- Any conduct or content of any Attorney or Client on the Platform
- Any unauthorized access to or use of our servers or personal information
- The outcome of any court appearance facilitated through the Platform
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless CourtConnect, HBZ Holdings, LLC, and their officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform or violation of these Terms.
11. Intellectual Property
The Platform and its original content, features, and functionality are owned by HBZ Holdings, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Platform without our prior written consent.
12. Dispute Resolution
Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Pinellas County, Florida. You agree to waive any right to a jury trial or to participate in a class action.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
14. Modifications
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after any modifications constitutes acceptance of the revised Terms.
15. Termination
We may terminate or suspend your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other Users or the Platform, or for any other reason.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.
